View Full Version : "...we don't pay overtime"

Hey everyone:

I got a job call from a job shop named in CT this week. The young fellow who told me about the job said "...but the don't pay OT". I said "Goodbye".

I'd like to know exactly what to say to these people when they call.

I've heard this discussion a couple of times on different jobs; someone has a story about some recruiter who got them or someone they knew an ***ignment where "we don't pay OT".

Now the way this story usually ends is that the individual took the job and then he decided (or someone urged him ) to sue the job shop for overtime wages due, and won the case.

From what I have heard, paying 1.5 x ST after 40 hours in a week is Federal Law and can't be avoided or evaded by ANYONE.

Would you all share what you know about this?

I think if your hourly, and not salary. They have to pay. Saying "Goodbye" was the kindest thing you could have said! Nextime I would say change the rate to 80hr on 40! Plus 100 / day Perdiem!:D

The problem is, they will unfortunatly find someone who either isnt any good or down on there luck to take that job, which hurts everyone

If you do physical work as in tech work, you are considered non-exempt and are entitled to overtime. If you are doing planning, procedure writing, instructing and jobs of this nature you are considered an exempt employee and they don't have to pay you overtime. I left (retired) my company after 20 years, partially because the accountants decided Foreman were exempt and stopped paying us OT or anything after 40 hours. Made it kind of hard to supervise a crew making double time when you're making nothing. I am working outages now and the exempt/non-exempt question is one of the first questions I ask.
